A removal action is considered time-critical when the lead agency, based on the site evaluation, determines that less than 6 months exists before on-site removal activity must begin. If a planning period of at least 6 months exists before on-site activities must be initiated, it is considered a non-time critical removal action. If an action is deemed time-critical, the lead agency can initiate the action without undue delay. However, the lead agency must publish a notice of availability of the administrative record file in a major local newspaper of general circulation within 60 days of initiation of on-site removal activity; provide a public comment period of not less than 30 days from the time the administrative record file is made available for public inspection; and prepare written responses to significant comments.
