What constitutes statutory rape?
Vaginal, oral, or anal penetration of a victim between the ages of 13 and 15 years of age is statutory rape. It is defined in the Michigan Penal Code ยง750.520das: A person is guilty of criminal sexual conduct in the third degree if the person engages in sexual penetration with another person and if any of the following circumstances exist: The other person is at least 13 years of age and under the age of 16 years of age; Force or coercion is used to accomplish the sexual penetration; The perpetrator knows or has reason to know, that the victim is mentally incapable, mentally incapacitated, or physically helpless. Criminal sexual conduct in the third degree is a felony punishable by imprisonment for not more than 15 years.
