On April 11, 2008, the union and commissioner’s office agreed to a revised drug policy, implementing many of the recommendations of the Mitchell report which were subject to collective bargaining. The commissioner’s office ratifified the policy on May 15 and the union ratified it on May 23. MLB had already implemented several other recommendations on its own because they did not affect the union. As part of the agreement, amnesty was given to all players named in the Mitchell report; the amnesty included Jay Gibbons and Jose Guillen, who were suspended just before the report came out but whose suspensions were appealed and put on hold pending negotiations. The new drug policy will be enforced by an administrator who serves a three-year term and cannot be removed except by an arbitator; this serves the goal of keeping the testing independent.
