Where a tree has been identified as being in a hazardous condition – This Authority does have the power to serve notice on the owner to enforce work to be carried out. If the tree is too tall, blocking light or overgrown – This Authority has no powers to enforce a private owner to carry out tree work. However it is envisaged that this may change once proposed legislation comes into force. For information on this legislation contact Planning Section 0121 569 4011. The tree is growing on private property, however it is overhanging the public footway/highway – This Authority can request that the owner has works done if this represents a health and safety issue please contact Highways on 0121 569 4157.
