What can I do if I think an employees workers compensation claim is invalid?

If you have investigated the claim thoroughly and reasonably believe the accident did not happen within the course and scope of employment you can send to the employee a Report of Claim Status (Form 38911) stating that their claim is not compensable. The employee does have the right to dispute this finding before the Board.
