What can be done to avoid jury nullification?
The state’s best opportunity to avoid impaneling a jury that may nullify a law comes during voir dire, the pretrial process in which prospective jurors are questioned to discover any indications of bias for or against the defendant or preexisting knowledge of the case. Prospective jurors who indicate a willingness to subvert the law will probably be subject to a challenge for cause by the prosecution and will thus be dismissed from serving on the trial jury.
