What can an applicant do if he/she receives a letter indicating that OMH is considering a denial?
The law specifically requires OMH to closely examine any applicants criminal history information which reveals a “presumptively disqualifying crime,” (a felony conviction at any time for a sex offense, a felony conviction within the past ten years involving violence, a conviction for endangering the welfare of an incompetent or physically disabled person, or a similar offense in any other jurisdiction outside of New York State). If an applicant has one of these convictions on his/her record, BCHI will send a letter to the applicant to request additional information in support of the application. If, upon receipt of the information provided by the applicant, BCHI determines that approval of the application for employment or volunteer service will not in any way jeopardize the health, safety or welfare of clients of the provider of mental health services, BCHI will not direct the provider to deny employment or volunteer service.Even if an applicants criminal history does not include one
