In some cases, the attorney files a Petition for Divorce for his client and the other spouse is served with a Citation and Petition by the constable or process server. If the other spouse does not file a written response, the spouse who files can obtain a Default Divorce. When the waiting period is over, that spouse and his or her attorney appear before the judge and, after a short hearing of three or four minutes, the judge will sign a Decree of Divorce and grant the divorce. In other cases, the spouse who does not file will receive a copy of the Petition and will sign a Waiver of Citation. In that case, no service by a constable or process server is necessary. The Waiver is filed with the court. The attorney and her client appear before the judge and, again, after a brief hearing, the judge will generally grant the divorce and sign the Decree of Divorce.
