Under the Assisted Human Reproduction Act, no payment can be made to a sperm or egg donor for their donation. However, until the regulations providing for the reimbursement of “reasonable expenses” and the licensing regime are in place, donors may be reimbursed for all or part of the expenses they incur in the course of their donation. The Act also allows for the creation of a Personal Health Information Registry (PHIR) of information about donors’ identity, personal characteristics, genetic information and medical history. This health reporting information, or HRI, will be collected by licensees and disclosed to AHRC as required by the regulations. The Act authorizes AHRC to use HRI to identify health and safety risks and for purposes of administering and enforcing the Act. However, all health reporting information collected by the Agency is confidential, and the Act allows donors to remain anonymous if they so wish.
