Upon the Possession Date for a given Farm, the Tenant will have the option for 60 days thereafter to clear the Farm Dwelling Site and the associated designated driveway area of any coffee trees or irrigation lines. Any trees, lines or other improvements (except for irrigation lines or other improvements within driveway areas that the Tenant specifies are still required for farming activities) that remain at the end of such sixty-day period shall be the responsibility of the Farm Owner and may be removed at the Farm Owner’s discretion. Prior to any ground (surface or subsurface) disturbance, the Farm Owner shall notify and coordinate the work with the LOA and KDC to ensure that remaining portions of the irrigation system are not damaged or rendered inoperable. In compliance with the requirements of the Lease and the Declaration, the Farm Owner will be permitted to remove or plant any vegetation on the Farm solely on Farm Dwelling Site (including the designated driveway area) and shall n
