What are the residency requirements for a divorce in New York State?
You may not commence a divorce proceeding in New York State unless you satisfy the residency requirements set forth in New York’s Domestic Relations Law. You satisfy the following if one of the following applies: Either you or your spouse has been a resident of New York for at least two years immediately preceeding the commencement of the divorce action. or Either you or your spouse have lived in New York for the last year or more and: a. The marriage ceremony was in New York State b. You and your spouse have resided as husband and wife in New York State c. The grounds for the divorce occured in New York State or Both you and your spouse live in new York State and the grounds occurred in New York.
