What are the Residency and Filing Requirements for Divorce in Indiana?
Either one of the spouses must have been an Indiana resident or stationed at a United States military installation within Indiana for six months immediately preceding filing a divorce petition. Additionally, at least one of the parties must have been a resident of the county or stationed at a U.S. military installation within the county for at least three months immediately preceding filing a divorce petition. (Indiana Code IC 31-15-2-6) Petitions for divorce should be filed in the civil division of the county superior court.
