What are the requirements for the H-1b category?
Basically, there are two main requirements for the H-1b category: (1) the position must require at least a bachelor’s degree, and (2) the foreign national must have at least a bachelor’s degree in a field of study related to the position. However, the employer has a few additional burdens, namely the employer has to promise that it will pay the foreign nurse the “prevailing wage” as determined by the U.S. Department of Labor. In addition, if the health care institution employs a lot of foreign workers in the H-1b category (generally about 15% of the workforce) then the institution must maintain proof that it is actively trying to recruit U.S. workers and that it is not terminating any U.S. workers to replace them with H-1b workers.
