Holiday units are not workplaces while occupied by holiday tenants. They do not, therefore, come within the scope of the Act or the Regulation. Although the Regulation does not cover residential-type situations like a holiday unit, the owner of the unit still has a general duty of care to ensure that holiday tenants are not exposed to safety hazards while staying in the property. The holiday unit and its fittings, including electrical equipment, should be maintained in a safe condition. This does not mean, however, that electrical equipment must be inspected and tested in accordance with the requirements of the Standard, AS/NZS 3760.
