A – Funds deposited in the court registry may only be released by court order. Counsel must file an Ex Parte Application For Order Releasing Funds From Court Registry and a Proposed Order. The Proposed Order must contain the following information: The Order must direct the Clerk of Court to release the funds (specify the principal amount which was deposited). If the funds were placed in an interest bearing account, the order must indicate that the interest is to be released. A W-9 form must also be filled out before the interest will be released. If the order does not direct the Clerk to release the interest, another order must be submitted in order for the interest to be released. The name and address of the person to whom the funds are to be released. There is a Clerk’s fee which is 10% of the interest earned. This fee is automatically deducted when the funds are released.
