What are the penalties for breaking and entering?
If in relation to a dwelling house, the charge is for an indictable offence with a maximum penalty of life imprisonment. If in relation to a place other than a dwelling house, the charge may be prosecuted as a summary conviction offence or as an indictable offence with a maximum penalty up to ten years in prison. There is a lesser offence in relation to a dwelling house—”being unlawfully in a dwelling house”—which may be prosecuted either as a summary conviction offence or by as an indictable offence with a maximum penalty up to 10 years in prison.
