What are the penalties for breaching an Order?
If protected trees are cut down without consent or destroyed or damaged in a way likely to destroy them, the person responsible may be fined up to £20,000 per tree or twice the sum which appears to the court to be their value, whichever is greater – on summary conviction, or an unlimited fine on inditement. For other contraventions there are lesser fines. The owner will be required to plant other trees unless the local Authority agree otherwise.
