The new amendments to the FMLA now grant additional leave to eligible employees who have covered family members in the military. Two categories have been introduced: 1) Military caregiver leave, allowing eligible employees who are the spouse, parent, child or next of kin of a service member who suffered a serious injury or illness on active duty to be able to take 26 work weeks of leave in a single 12 month rolling period to care for the service member. 2) Qualifying exigency leave, allowing eligible employees who have a spouse, parent or child as a Reservist or National Guard member and the service member has been called to active duty, to take up to 12 work weeks for a “qualifying exigency” as defined by the amendments.
