What are the miscellaneous provisions of the DLEP 2009?
The DLEP 2009 contains all the statutory (or planning law) controls that apply to development, which includes things such as land zoning, height of buildings and minimum lot sizes for subdivision. In addition to these matters, it also contains some new provisions that are mandated by DoP in relation to things such as acid sulphate soils and flood liable land. Some local provisions, such as provisions to allow the Coastal Open Space System to continue, are also included. It also contains a list of exempt development (where no council approval is required for certain minor works) and complying development (where approval is not required however a development must be certified by an accredited person or council).
