A UK application can be refused on 2 grounds namely absolute and relative grounds. Absolute Grounds These grounds include, but are not limited to marks devoid of any distinctive character, marks which may serve in trade and designate quality, kind, quantity, intended purpose, value, geographical origin, when and how they were produced, trademarks which consist exclusively of signs or indications which have become customers in the current language or in a bona fide and established practices of the trade. A mark will not be registered as a trade mark if it consists exclusively within the shape which will result in the goods themselves the shape of the goods which is necessary to obtain a technical result, or the shape which gives substantial value to the goods contrary to public policy or to accepted principles of morality, or of such a nature as to deceive the public ( for ex ample, as the nature, quality, or geographical origin of the goods or services) A trademark will not be register
