What are the main changes resulting from the new Act and Regulation?
The main change resulting from the OHS Act 2000 is a new duty for employers to consult with employees on matters affecting their health and safety. The duty to consult applies to all employers regardless of the number of employees at the workplace. (Chapter 3, Clauses 21-32) The OHS Act 2000 establishes the duty to consult (Section 13) and establishes when and how consultation is to be undertaken (Sections 14-18). The OHS Regulation 2001 sets further provisions relating to the setting up of consultation arrangements and the training of OHS committee members and OHS representatives.
