What are the limitations of differentiated case management?
A limitation of differentiated case management is that there is no guarantee that a court will know what cases are appropriate for simplified procedures, what are the most appropriate modifications to make, and what goals should guide the formation of deadlines and schedules. As a result, to ensure complex cases are not incorrectly differentiated, courts need to monitor the transferring of cases from simplified to regular calendars when judges and attorneys find that some cases require more litigation, case preparation, or time than the simplified procedures allow. If more than a small percentage of cases are transferred, the court should quickly reassess the differentiation criteria and their application to maintain efficiency and quality.
