What are the legal issues associated with background checking?
Whilst there are currently no laws in the Cayman Islands which specifically relate to background checking, we strive to comply with all applicable international regulations and best practices. In the US, the main federal law relating to background screening is the Fair Credit Reporting Act (FCRA). The FCRA is intended to ensure that the information contained in a background screening report is accurate and up-to-date and that the user of the screening report has a legitimate right to request and view the report. In addition, the Act requires that applicants be notified of a pre-employment background check and before a background check can be initiated, the applicant must sign a release consenting to it. Many states have enacted laws regulating the procurement and use of background reports.
