In the US, the main federal law relating to background screening is the Fair Credit Reporting Act (FCRA). The FCRA is intended to ensure that the information contained in a background screening report is accurate and up-to-date and that the user of the screening report has a legitimate right to request and view the report. In addition, the Act requires that applicants be notified of a pre-employment background check and before a background check can be initiated, the applicant must sign a release consenting to it. Many states have enacted laws regulating the procurement and use of background reports.
