What are the individual rights which HIPAA privacy rules give to plan participants and beneficiaries?
A. Generally speaking, individuals have five central rights. These include the right to request an accounting of the uses and disclosures which have been made of their PHI over the past six years; the right to request restrictions on the disclosure of PHI; the right to access or see their PHI to determine what is there; the right to have their PHI modified if it is incorrect; and the right to receive a Privacy Notice.
