Section 99 of the PSMA precludes matters related to public sector ethics, standards or approved procedures from being varied, bargained away or included in an industrial instrument thereby ensuring these issues are dealt with consistently across the sector. On 1 December, s57 of the Public Sector Reform Act 2010 will take effect repealing section 99 of the current Act. The Department of Commerce remains responsible for the overall management of government policy related to negotiation of industrial agreements.
