It is still possible to take separate proceedings to prove a party’s final entitlement to a payment claim. • All persons preserve their contractual rights. • Nothing under the Act affects any right that a party has under a construction contract. • Nothing under the Act affects any civil proceedings before a court or tribunal in relation to any matter arising under a construction contract.
