What are the Immigration and Naturalization Requirements?
The Immigration and Naturalization Service of the United States of America (INS) controls and monitors the immigration process for working in the US. The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA) governs the conditions under which an alien may immigrate to the US. The process involved is multifaceted and complex. For most occupations, the Department of Labor (DOL) is required to certify that US workers, qualified for the job being offered, are unable to fill the position. For some types of positions, the DOL has found that this is unnecessary because there is a chronic shortage of US workers. These positions are pre-certified. Registered nurses, because of the chronic shortage nationwide, do not require labor certification.
