What are the guidelines for expenditures that are eligible for reimbursement under the Unreimbursed Medical FSA?
An Unreimbursed Medical FSA may reimburse only medical expenses that are defined in Code Section 213. Most of the health care expenses that may be deducted on an employee’s Federal income tax return are eligible for reimbursement under this plan. Though in NO case may a participant use this plan to pay premiums, even though premiums are allowable under Code Section 213 as a personal medical expense. In addition, this plan must reimburse only expenses that are incurred during the plan year, regardless of when the expenses are actually paid. Taxpayers reading IRS Publication 502 will see guidance relating to the date an expense is paid. These instructions do not apply to Unreimbursed Medical FSAs.
