What are the grounds for divorce in New York?
New York allows for five separate grounds to seek a divorce, and these are found in the Domestic Relations Law. Four are based on the fault of the party, including: cruel and inhuman treatment, abandonment for one year or more, imprisonment for three years or more and adultery. The fifth ground is based on no fault of either party: a court judgment of separation or a separation agreement signed by the parties, after either of which one year or more has passed.
