WHAT ARE THE GROUNDS FOR DIVORCE AND LEGAL SEPARATION IN ILLINOIS?
The most commonly used grounds for divorce and legal separation are irreconcilable differences, mental cruelty, desertion and physical cruelty, and those grounds will be discussed in detail below. Other grounds recognized by law are adultery, bigamy, natural impotence, habitual drunkenness for at least two (2) years, drug addiction for at least two (2) years, attempted murder on you by your spouse, felony conviction and transmittal of venereal disease. These grounds must have occurred without “cause or provocation” on your part, if you are seeking the divorce or legal separation. Since July 1, 1984, “irreconcilable differences” is considered a ground for divorce.
