In general, a swimming pool may be placed in a rear yard, provided the pool does not exceed 5 feet in height and is not nearer than 10 feet of any property line. Every swimming pool shall be completely enclosed by a wall or fence of sturdy construction not less than 60 inches in height, measured from the ground level at each point along the circumference of such enclosure. The enclosure shall be of such design and construction as to prevent young children from crawling or otherwise passing through, under or over such enclosure without the use of tools, ladders or other artifice. Each gate in the enclosure described above shall be constructed so as to automatically close to a locked position, and shall be kept securely locked at all times except when the pool is in use and under the immediate observation of the owner or other responsible person designated by the owner.
