If a team has determined that the child meets the performance criteria for a learning disability, before it can decide that the child has a learning disability it must determine that its findings are NOT the result of: visual, hearing or motor disability; mental retardation; emotional disturbance; cultural factors; or environmental or economic disadvantage. In addition, the child’s performance must not be primarily as a result of lack of appropriate instruction in reading and math, or of limited English proficiency.
