What are the essential rights conferred by the registered community design?
The registered community design gives its holder the exclusive right to use it and to prevent any third party from using it without his consent. This right does not depend on whether the design is the result of an independent creation or whether the third person knew the registered design. Please note, that the Regulation for Community Design provides a limited right of prior use to any third person who started to use a registered design before its application/priority date in good faith, as long as it has not been copied from the Community design.
