What are the eligibility requirements for legal services programs?
Eligibility requirement vary depending on the program. However, people with income below the federal poverty guidelines are generally eligible for free legal help through these programs. Cases are ranked based upon their type and the facts involved. Some cases are given a higher priority than others because of the risk of harm involved in the case. Some states have set up low bono programs, which permit individuals who do not qualify to get free legal advice to get legal advice at a reduced price. Still other pro bono programs provide free legal services to all citizens who cannot afford legal representation, regardless of whether they meet income requirements. People who are elderly, disabled, or the victims of domestic violence; are enlisted in the military; or have other special circumstances may be eligible for help even if their income is a little higher than the poverty guidelines.
Each program will have different eligibility requirements; you need to check with the program to find out its eligibility requirements. At Indiana Legal Services, the person who wants an attorney must meet financial eligibility requirements and some other requirements. Often the financial eligibility requirement is related to the Federal Poverty Guidelines.
