The Guardian of the Person is in essence a fiduciary. As such, his actions are held to the standard that all fiduciaries are held. Accordingly, the Guardian of the Person is required to post a bond to ensure that he fulfills his duties to the ward. The Guardian’s duties can be restricted by the court, but generally include the duties of: care; protection and control of the ward; and providing the ward with food, shelter, clothing and medical care. The Guardian is also charged with the power to consent to medical care of the ward and surgical treatment. The Guardian also has the power to consent to psychological treatment of the ward, within limits. For example, the power to commit the ward to in-patient psychiatric is limited.
