What are the districts responsibilities if they are having difficulty securing a highly-qualified and certified ESL teacher to provide ESL services?
CR Part 154 requires that all identified LEP/ELLs must receive the required ESL and Native Language instruction, if in a bilingual program. If a certified ESL or bilingual teacher is not available, the district must follow immediate steps to provide alternative instruction elsewhere, as directed in Education Law 3214(e). Districts are not exempt from this requirement.
