What are the different types of probation?
There are two types of probation available in Texas. The first is referred to as straight probation. When you are given straight probation, even if you successfully complete the terms of probation, you will have a conviction for that offense on your record. The second type of probation is Deferred Adjudication. When placed on deferred adjudication probation and you successfully complete the probationary term, the charge against you is dismissed and there is no final conviction for that offense on your record. Furthermore, if you successfully complete your deferred adjudication probation you may be eligible for a Non Disclosure Order to clear your record entirely. Another difference between straight probation and deferred adjudication probation can be the length of sentence handed down in the event you are found to have violated the terms or conditions of your probation. In straight probation, the Judge can only sentence you to the length of time that was originally imposed and probated
