Psilocybin is a Schedule I drug deemed by the DEA. Schedule I drugs are those drugs or substances that have a high potential for abuse and no currently accepted medical use in the United States. Criminal penalties are based on whether or not this is a first offense, the quantity of the drug as well as possession or possession with intent to distribute. Under the Controlled Substance Act, a judge may grant probation to a first-time offender convicted of simple possession, but doing and possessing drugs is a risky act that Pat does not recommend.
