• If the payment claim is valid, the full amount of the claim is deemed to be due and payable. • The Claimant can recover the unpaid portion of the claim as debt in summary court proceedings. • In any summary court proceedings the Respondent cannot raise any cross claims in respect of the construction contract (i.e. that the work was not actually done or is defective). • The Claimant may suspend future work with 2 business days notice if the amount claimed is not paid by the due date.
