Destroying any record subject to the Act with the intent to evade a request for access is an offence and the individual is liable to a fine of $2000.00 or six months in prison or both. Additionally, the same penalty can be imposed if you change or destroy a record that is the subject matter of a request in order to mislead the person who has made the request. Such a violation would have to be very clear and intentional for this to be in anyway a concern.
