What are the conditions of use for «Made in Switzerland» designations?
«Made in Switzerland» designations are considered indications of source which may be freely used as long as they are appropriate or cannot be confused with an inappropriate indication of source (see Questions 6 and 7 “Swissness”). This basic requirement is accordingly maintained. The legislative amendment, however, envisions more precise criteria for determining the actual source of a Swiss product (see Question 14). The illegal use of indications of source can be prosecuted if criminal charges are filed. Plaintiffs are any persons who have the legal right to use this designation. Whoever intentionally and illegally uses a misleading designation can be penalized with a custodial sentence of up to one year or a fine. If the offender acts commercially, the act is punishable with a custodial sentence of up to five years or a fine. The maximum fine allowed is 1,080,000 francs.
