What are the available protections for Trademark, Patent or Designs holders in Marshall Islands?
The non-availability of trademark, and Patent legislation and registration mechanism in the Marshall Islands does not mean that the one cannot enforce its right and seek remedy before the courts of the Marshall Islands. The common law of Passing off for trademarks is available for any complainants. The Marshall Island has a well-distributed newspaper the Marshall Islands Journal where trademark notices may be posted.
