What are Pre-Trial Motions?
Pre-trial motions are generally made by the defense attorney and the prosecutor and presented to the judge so that certain issues may be resolved before trial. Often, these motions seek to limit the evidence that the other side may offer at trial, such as a defense attorney’s motion to exclude his client’s confession. If the motion to exclude is successful, the prosecutor will be prohibited from mentioning the defendant’s confession at trial, and it will not be allowed into evidence.
