In Oregon, we have what is called “no fault” divorce. This means that it is not necessary to prove adultery, abandonment, cruelty, or other types of marital misconduct on the part of one spouse for a divorce to be granted by the courts. An allegation that you and your spouse have developed “irreconcilable differences (i.e. you are no longer getting along)” is all that is required. A divorce may be requested by either spouse without the permission of the other, and one spouse cannot stop a divorce if the other wants one. The spouse filing the petition for divorce must have lived in Oregon for at least six months prior to such filing and the petition must be filed in the county in which either of the spouses lives.
