What actions must the IEP team take at the meeting to meet the requirements of consideration of the independent educational evaluation (IEE)?
The IEE is an evaluation done by a multidisciplinary team outside of the school district for the purpose of getting a second opinion regarding the nature of the disability, services needed, and placement. While it is clear that a school district’s obligation to consider the IEE will not necessarily end in the adoption of the IEE, it is not so clear what the process of consideration means. The Individuals with Disabilities Education Act does not include a statutory definition of what it means to “consider” a private IEE; nor are there any requirements specifying the exact weight it must be given. In Letter to Anonymous, 23 IDELR 563 (OSEP 1995), OSEP states that the IEP team must review the IEE, discuss its results and, to the extent it is not adopted, discuss the basis for any disagreement.
