What actions did the Division office take in reviewing the permit application?
A previous Division Engineer, Brigadier General Stephen Rhoades, issued an interim decision in September of 2002 that identified three areas of the permit application file that needed to be resumed and completed. They were: 1) National Historic Preservation Act coordination; 2) submission by the permit applicant, the City of Newport News, Virginia of an updated wetlands and streams mitigation plan which provides no net loss of wetlands values; and 3) the Commonwealth of Virginia’s determination that the proposed project is in compliance with the Commonwealth’s Coastal Zone Management Act Program. National Historic Preservation Act coordination successfully concluded in a June 27, 2005 Section 106 Memorandum of Agreement for identification and treatment of cultural and historic resources. The City of Newport News’ June 2004 Streams & Wetlands Mitigation Plan, after agency and public review and comment meets with applicable regulations and policies and has been found acceptable.
