What action does ITSR take when it receives a drug and alcohol testing notification from a rail transport operator?
ITSR reviews notifications (of positive test results, refusal or failure to be tested, and interfering with test results or blood or urine samples) and investigates serious offences. ITSR may require the testing officer to provide a written statement. The operator may also be required to document the action it has taken in accordance with its drug and alcohol management program, eg. removal of the rail safety worker from rail safety work, counselling and/or disciplinary action, return to rail safety work following a negative test result and clearance from a counsellor, and monitoring for a set period. It should be noted that even if an operator takes disciplinary action in accordance with its drug and alcohol management program, ITSR may still decide to take regulatory action.
