North Tonawanda, NY (WBEN) An area attorney says the DWI deal brokered by the Niagara County District Attorney, the attorney for a DWI suspect, and a city court judge was all legal. Michael Taheri tells WBEN the DA should be commended for “taking a risk.” Taheri says pleading down to less than a DWI offense is acceptable under the state’s DWI statute. “It requires an evaluation by the district attorney, and the court must approve the disposition. Even though it’s rare, it happens, and it’s happened with one of my clients,” says Taheri. Taheri says several factors must come into play, including whether the crime fits the DWI statute to begin with, the defendant’s criminal and driving history, a discussion with police and a look at the BAC score. “They’re gonna make an overall judgment about what does justice require,” says Taheri.
