We have been asked whether we could take on a student to undertake some school duties. What are the insurance implications?
As regards public and employers liability Insurance there are no age restrictions. Students and trainees including children, subject to employment law are regarded in health & safety law as employees. Students on placements must be provided with the same health, safety and welfare protection given to other employees. Restrictions may apply to the types of work which young people, including pupils below the MSLA (minimum school leaving age) on work experience, are allowed to do. For more information on Employment Law and Health & Safety use the following link: HSE – Young people and work experience [Opens in New Window] The school needs to inform students of their main duties and tasks, the type of work, any associated specific risks and their controls measures, and remind the students of their responsibilities whilst on placement. Parents/guardians will also have to be told of these risks. This will form part of the risk assessment undertaken by the Work Experience Co-ordinator.
