Was the Roe v. Wade Decision Unanimous?
The Roe v. Wade decision was not unanimous. The decision was split 7-2, with Justices Byron R. White and William H. Rehnquist voting against Roe. Misconceptions Many people believe that the U.S. Constitution explicitly mentions a right to privacy. This is not the case. However, the U.S. Supreme Court has recognized that a right to personal privacy, or a guarantee of certain zones of privacy, does exist implicitly under the Constitution. The right to privacy can be inferred from the First, Fourth, Fifth and Fourteenth Amendments, as well as the Bill of Rights.
